The National Right to Repair Act’s Automotive Impact

The REPAIR Act is a bipartisan piece of legislation slowly making its way through Congress. The act already has the support of more than 30 lawmakers and several influential automotive groups, including the Consumer Access to Repair (CAR) coalition. The bill will play a critical role in protecting car owners from unnecessary repair expenses and overreach from manufacturers.

What is the Repair Act?

Some states already have similar legislation on the books. Michigan’s Right to Repair Act, or Act 300 of 1974, allows the state government to regular automotive repair and is designed to protect consumers from unfair practices by technicians and manufacturers.

The National REPAIR Act brings similar measures to all states. Right-to-repair protections entered the federal spotlight largely due to the increase in telematics. Today, about 50% of cars on the road have some level of connected capabilities – by 2030, McKinsey expects that number to exceed 95%.  

It’s About Control

Especially for hybrid and electric vehicles, telematics allows for real-time diagnostics, allowing automated systems to monitor performance and even make some repairs. This system can be extremely beneficial, but it comes with inherent risks. Proprietary telematics can’t be accessed by third parties, making the manufacturer a biased gatekeeper to the car’s data.

Without oversight, that control could lead to:

  • More expensive repairs

  • Limited consumer choice – consumers may be forced to dealerships or licensed garages

  • Lack of privacy and control over data

Fighting for Consumer Rights

The REPAIR Act has the support of influential automotive groups, including the Auto Care Association, CAR Coalition and several other organizations. Compromised of auto insurers, automotive technicians’ groups, and consumer advocacy organizations, the REPAIR Act is built around four key pillars: 

  • Prevents manufacturers from establishing barriers to diagnostics, maintenance and repairs.

  • Vehicles owners much have access to the data generated by their vehicles

  • Ensures consumer choice to all repair options

  • Established a committee to monitor the industry and remove any barriers to repair
